Mr. Smith focuses his practice on civil and ERISA litigation in state and federal courts. He represents Taft-Hartley employee benefit funds in all matters, including collection actions, fiduciary breach claims, employment concerns, ERISA compliance, and IRS and DOL audits, mechanic’s liens, bond claims and other state law enforcement actions. Mr. Smith has significant experience representing creditors in bankruptcy and adversary actions. Mr. Smith represents investors in actions for fraud, unjust enrichment, and fiduciary breach.

Mr. Smith is admitted to practice before the United States Supreme Court, the Ninth Circuit Court of Appeals, the United States District Courts for the Districts of Nevada and Utah, and the Supreme Courts of Nevada, Washington and Utah. Mr. Smith is a member of the State Bars of Nevada, Washington and Utah.

Prior to entering the practice of law, Mr. Smith received his Juris Doctor from the J. Reuben Clark Law School at Brigham Young University, where he served on the Moot Court Executive Board and was the primary brief writer for the school’s National Moot Court Team. Mr. Smith completed summer clerkships at the Southern California firm of Gresham Savage Nolan & Tilden and in the legal departments of Fortune 500 Companies Pfizer, Inc. in Manhattan and John Deere in Iowa. Mr. Smith graduated cum laude from Utah Valley University with a bachelor of science in criminal justice.
